Terms and Conditions

Assumption of Risk and Waiver of Liability
a. Thermal Pane Fogging or Moisture Between Panes:
NDSolution is not liable for any water intrusion between window panes, including but not limited to double- or triple-pane (insulated) glass. This condition is typically a result of failed window seals, which are pre-existing manufacturing or wear-related defects outside of our control.
b. Pre-Existing Damage:
NDSolution is not responsible for any pre-existing conditions or damage to windows, screens, frames, sills, tracks, paint, landscaping, or structures. This includes, but is not limited to, cracked or chipped glass, loose frames, oxidized screens, rotted wood, or brittle caulking.
c. Surfaces and Materials:
Certain surfaces may be at risk of scratching or wear due to prior damage, improper installation, or materials incompatible with standard window cleaning practices. NDSolution shall not be held responsible for issues arising from these conditions.
d. Dislodged Window Panes During Regular Cleaning:
Some windows, especially older or improperly installed ones, may have loose panes that are not visibly apparent. If a window pane becomes dislodged or falls out during the regular cleaning process (using standard tools and techniques), NDSolution is not liable. This type of issue is typically due to structural defects or prior damage beyond our control.
Scope of Work
a. Standard Service:
NDSolution’s window cleaning services include the removal of dirt, dust, and debris from glass surfaces using standard tools and cleaning solutions.
b. Exclusions:
Hard water stain removal, paint overspray scraping, adhesive removal, concrete removal, tree sap removal, or any restoration-level services are not included unless explicitly agreed upon in writing prior to service. These services may incur additional charges and require scheduling adjustments.
Deposits, Recurring Services, and Payment Terms
a. 10% Deposit Requirement:
After an estimate and service plan selection, a non-refundable deposit of 10% of the total service cost is required to reserve the scheduled service date. This deposit confirms your booking and covers preparation and scheduling time.
b. Deposit Credit Policy:
If the client decides not to proceed with the scheduled cleaning, the deposit will not be refunded but may be credited toward future services, including additional or rescheduled cleanings, at NDSolution’s discretion.
c. Recurring Service Clients:
Clients who select a recurring service plan (e.g., quarterly cleanings) will be charged in advance for each scheduled cleaning. If a client cancels a scheduled cleaning, the payment already charged for that cleaning will not be refunded but credited toward any additional services for the next cleaning, as arranged with NDSolution.
d. Late Fees:
Any unpaid balances are subject to a late fee of 10% per month, applied monthly on overdue amounts until paid in full.
Damage Caused by NDSolution Negligence
In the rare event that NDSolution causes damage that is not pre-existing and is a result of our direct negligence, we accept responsibility. We will, at our discretion:
Repair the item or area to its pre-loss condition, or
Provide indemnification through reasonable compensation, or
Coordinate with our insurance provider for coverage, if applicable.
Clients must report any such damage within 48 hours of service completion.
Client Responsibilities
a. Client agrees to provide clear access to windows and work areas prior to arrival.
b. Client agrees to secure pets, valuables, and fragile items.
c. Client acknowledges that window cleaning may temporarily affect window tinting, seals, or treatments if these are not properly installed or previously compromised.
Weather and Safety Conditions
Services may be rescheduled or delayed due to weather or unsafe working conditions. NDSolution reserves the right to make such determinations in the interest of safety and quality.
Photo and Video Release
By allowing NDSolution to perform services on your property, you grant NDSolution permission to capture photographs and videos of the work performed. These images and recordings may be used for marketing, documentation, or educational purposes without additional consent or compensation.
Force Majeure
NDSolution shall not be liable for delays or failure to perform services due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, government restrictions, or other unforeseeable events.
Limitation of Liability
Except for damages caused by NDSolution’s direct negligence, the total liability of NDSolution under or in connection with these Terms and Conditions shall not exceed the total amount paid by the client for the specific service giving rise to the claim. In no event shall NDSolution be liable for any indirect, incidental, consequential, or punitive damages.
Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the services were performed (either California or Idaho). Any disputes arising out of or related to these Terms shall first be attempted to be resolved through good faith negotiations.
If negotiation fails, disputes shall be resolved through binding arbitration administered in the state where the service was provided, in accordance with the rules of a recognized arbitration organization. Judgment on the arbitration award may be entered in any court having jurisdiction.
